1. Acceptance of Terms

By accessing or using the Enthrone Initiatives website at enthroneinitiatives.org (the "Site") or making a donation through our platform, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors, users, donors, volunteers, and partners who access or use the Site. We reserve the right to update these Terms at any time. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Use the Site to transmit unsolicited communications (spam) or engage in scraping
  • Impersonate Enthrone Initiatives or any of its staff, board members, or authorized representatives

3. Donations

Donations made through this Site are processed by Stripe, Inc., a third-party payment processor. By submitting a donation, you authorize Enthrone Initiatives to charge your payment method for the stated amount.

All donations to Enthrone Initiatives Inc. are final and non-refundable unless otherwise stated in our Donation Policy. Recurring donations may be cancelled at any time per the procedures described in the Donation Policy.

Enthrone Initiatives is a 501(c)(3) tax-exempt organization. Donations are tax-deductible to the extent permitted by law. A receipt will be provided for tax purposes. For donations of $250 or more, a written acknowledgment will be provided as required by IRS regulations.

Enthrone Initiatives reserves the right to decline any donation at its discretion, particularly donations from sources inconsistent with our values, legal obligations, or organizational policies.

4. Donor Accounts

You may create a donor account to access additional features such as donation history, tax receipt downloads, and initiative updates. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and truthful account information
  • Notifying us promptly of any unauthorized use of your account

We reserve the right to terminate accounts that violate these Terms or that we determine, in our sole discretion, are used for fraudulent or harmful purposes.

5. Intellectual Property

All content on this Site, including but not limited to text, photographs, graphics, logos, videos, and software, is the property of Enthrone Initiatives Inc. or its content suppliers and is protected by applicable intellectual property laws.

You may view, download, and print materials from this Site for personal, non-commercial use only, provided you do not modify the materials and you retain all copyright and proprietary notices. Any other use, reproduction, or distribution without prior written permission from Enthrone Initiatives is prohibited.

The Enthrone Initiatives name, logo, and related marks are trademarks of Enthrone Initiatives Inc. Nothing on this Site grants you any license to use our trademarks.

The Site may contain links to third-party websites or services not owned or controlled by Enthrone Initiatives. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ENTHRONE INITIATIVES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ENTHRONE INITIATIVES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THESE TERMS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU DONATED TO ENTHRONE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

9. Indemnification

You agree to defend, indemnify, and hold harmless Enthrone Initiatives Inc., its officers, directors, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Site shall first be submitted to good-faith negotiation. If unresolved after 30 days, disputes shall be resolved by binding arbitration in Buffalo, New York, under the rules of the American Arbitration Association. You waive any right to a jury trial or class action arbitration.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
